独学でもがんばる法！その２
いや～、早いなあ、しかし！今日で11月も終いやでえ。紅葉シーズンもこんで終わって、今度はクリスマスまで駆け足やなあ。 新年会＆決起集会の件、たくさんの書き込みありがとね！！ 受かった人もアカンかった人も来てもらえそうで、うれしいっす！ほんま、励みになるわあ。投稿ではなく直接メールくれた方もいはりますし。にぎやかになるなあ！あと、私の講義を知らない受験生の方とか、来年初挑戦の方とか、是非、来てくださいね！私を知ってるとか知らないとか、ほかの先生と勉強してるとか、もちろん「社労士予備校」を利用するしないは参加資格と違うからね。 「来年こそは！」と思っている方ならどなたでもＯＫっす！ 具体的な日時と連絡方法は、近日中に発表します。 さ～て、じゃ、独学者に送る第2弾。きょうは、テクニック編その１。 ぼくのやった方法をそのまま書いてみます。ちなみに、私の時代は、毎年7月最終火曜日が試験でした。 まずは、スケジュールを決めました。3月末をリミットとして、11月から5ヶ月間で、労働・社保のテキストを自分なりにインプット（この場合はざっくり覚えること）しようという計画で、あとは、単純に1週何ページという区切り程度。入念な計画はしなかった。単に、総ページ数÷週数（日で決めても予定通りいかんからなあ）。ところがさ、いざ始めてみると、内容的に簡単なとことそうでないとこがあることに気づいた（独学でなんも知らんからそこまでアタマがまわらなかった）。読んでわかるスムーズなとこはできるだけパッパッといって、難しいとこはじっくり考えて。そやけど、前述のとおり、アタマがいいほうではないので、考えてもわからんとこはサッパリわからなくて。なんでこうなん？とか、どういうときにこうなんの？とか。しかし、1週間というサイクルで予定した以上、そこで留まることはできず、結果的には、ほっとくことにした。というのもね、そういうつまづいてどうしようもないとこは、意外と過去に出てないことに気づいたわけよ。ま、よくありがちな話、ムダなところは極力省く、「割り切り学習」に切り替えたわけです。んんん～、年末ぐらいかなあ、徴収法あたりからやったと思う。な～んや、出てへんやん！と思ったとたん、やらんでもええで～って「お告げ」があった。 なんか、宗教めいた話になってきましたが、もうちょい次回に続きます。 【問題０２８の解答解説】 答 ②葬祭料及び葬祭給付以外の保険給付 （昭55.12.5基発673号） 返還金債権に優先的に充当する保険給付は、「②葬祭料及び葬祭給付以外の保険給付」とされる。具体的には、遺族（補償）年金、遺族（補償）一時金、障害（補償）年金差額一時金の3系統6種類。なお、「①葬祭料及び葬祭給付」は逆の記述であり、また、「③一時金たる保険給付以外」は、一時金グループが除かれるため不適当である。 山川靖樹の社労士予備校【基礎答練】はこちら → http://www.ab.auone-net.jp/~y.yasuki/sub2.html 【今日の問題】 問題０２９ 労働者が、刑事施設、労役場その他これらに準ずる施設に拘禁されているとき等であって、厚生労働省令で定める場合に該当するときは、□□□ は行わない。 ①保険給付（死亡に係るものを除く） ②逸失利益のてん補を目的とする保険給付 ③休業補償給付（休業給付についても準用） ＊12月からは「雇用保険法」に変わります。 --------
